Terms and Conditions
- General
- These terms and conditions (Terms) apply to the supply of all solar systems and installation services, and all quotations provided, by Cardinal Solar.
- Quotations and Orders
- Acceptance of the quotation by the person named on a relevant quote or proposal (Quote) (the Customer):
- must be provided in writing within the timeframe specified in the quotation, either by:
- the Customer signing a copy of the quotation and contract of sale (in hard copy or digitally) at the time of the Cardinal Solar representative’s visit to the Customer’s premises (Premises); or
- by email from the Customer, attaching a copy the contract of sale, to the email address specified on the quotation; and
- constitutes an order by the Customer for the purchase of the specified system components and installation services, on these Terms, which may be accepted or rejected by Cardinal Solar.
- must be provided in writing within the timeframe specified in the quotation, either by:
- At the time of accepting the quotation the Customer must:
- notify Cardinal Solar of their choice in payment method; and
- pay a deposit in the manner specified in the quotation. Cardinal Solar will not arrange for the installation of the solar system at the Premises until the Customer has paid the deposit in full.
- Acceptance of the quotation by the person named on a relevant quote or proposal (Quote) (the Customer):
- Cancellation of Orders
- Cardinal Solar may cancel an order at any time before installation of the solar system at the Premises.
- Once an order has been accepted by Cardinal Solar, it may only be cancelled by the Customer with the written consent of Cardinal Solar.
- Refunds
- Any payments made by the Customer (including the deposit) will only be refundable if:
- Cardinal Solar cancels an order under clause 3.1 of these Terms;
- the application for grid connection approval under clause 7.1 is rejected; or
- the Customer withdraws from the purchase and installation of the solar system in accordance with the cooling-off provisions set out in clause 5.
- Any payments made by the Customer (including the deposit) will only be refundable if:
- COOLING-OFF PERIOD
- If the total fees associated with Our performing domestic building work in the Proposal exceed $3,300.00 incl. GST then You may withdraw from the Agreement within five (5) business days after the day You receive a copy of the signed Agreement. However, there are costs for homeowners in withdrawing (generally $100.00 plus any out-of-pocket expenses reasonably incurred by Us up to the time of withdrawal). You must advise Us in writing that You are withdrawing under the cooling off provisions in section 35 of Schedule 1B of the Queensland Building and Construction Commission Act 1991 (Qld).
- If Cardinal Solar has engaged You in your home or place of business, then You may withdraw from the Agreement in writing within ten (10) business days after the day You receive a copy of the signed Agreement.
- Small-scale Technology Certificates
- The Small-scale Technology Certificates (STCs) incentive discount will appear on the quotation as a deduction from the total purchase price. By accepting the price in the quotation, the Customer acknowledges that it is assigning to Cardinal Solar its right to create STCs. Non-assignment will result in the discount no longer being deducted from the total purchase price.
- The Customer acknowledges that the price of STCs is driven by supply and demand and can therefore fluctuate. The STC value shown in the quotation is correct as at the date of the quotation but may vary between the date of the quotation and the date of installation. Cardinal Solar reserves the right to adjust the STC value if it has changed at the time of installation.
- Grid Connection Approval
- Cardinal Solar will apply for grid connection approval on behalf of the Customer as soon as the Customer accepts the quotation and provides Cardinal Solar with the required information.
- Installation of the solar system cannot commence until grid connection approval has been granted. The Customer acknowledges that installation will be rescheduled if grid connection approval has not been granted by the installation day.
- Delivery and Installation
- The components of the solar system will be brought to the Premises by Cardinal Solar’s installation team, or a contractor of Cardinal Solar, on the date and at the time agreed by Cardinal Solar and the Customer. The Customer or an authorised representative must be present at the Premises at the agreed time to give the installation team all necessary access to the Premises to enable installation to occur.
- The Customer is responsible for ensuring the Premises, including the roof, supporting structures and electrical wiring, are safe and able to accommodate the installation of the solar system.
- The Customer is responsible for ensuring that any animals on the Premises are secure so as not to cause any hazard for the duration of the installation.
- Cardinal Solar will not be liable for any damages, losses, costs or expenses incurred by the Customer if the installation date is rescheduled for any reason, either within or beyond the control of Cardinal Solar.
- Prices and Payment
- An invoice for the balance of the purchase price, which may take into account any adjustments to the STC value as described in clause 6.2, will be issued by Cardinal Solar once the solar system has been installed and commissioned at the Premises.
- Payment of the balance of the purchase price must be made by the purchaser immediately and in the manner notified to Cardinal Solar under clause 2.2(a).
- Payment under these Terms can be made by [insert].
- GST and Other Taxes
- Unless otherwise stated, the purchase price is inclusive of GST.
- Terms used in this clause 10 that have a defined meaning in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) have the same meaning in this clause.
- Any and all other taxes and duties will be borne by the Customer.
- Title
- Notwithstanding installation of the solar system at the Premises, all components of the solar system remain the property of Cardinal Solar until full payment for the solar system and its installation has been received by Cardinal Solar.
- Australian Consumer Law and Warranty
- Nothing in these Terms excludes, restricts or modifies any of the Customer’s rights, guarantees or remedies which cannot be excluded, restricted or modified under the Australian Consumer Law (ACL).
- In addition to the Customer’s rights under the ACL, workmanship and products supplied by Cardinal Solar come with a minimum five (5) year warranty. Any further warranty periods will be set out in the applicable owner’s guide and/or installation instructions. The Customer’s rights under any warranty are in addition to, and do not limit or detract from, the Customer’s rights arising under the ACL.
- In accordance with the ACL, any goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired.
- Internet Connectivity
- Where a product purchased from Cardinal Solar has internet connectivity capabilities, the Customer:
- acknowledges that those capabilities enable the Customer to acquire additional services or functionality from third party service providers;
- is responsible for maintaining the product’s connection to the internet and all costs associated with that connection (including internet services provider costs); and
- acknowledges that, subject to clause 12, Cardinal Solar is not responsible for any issues with the internet, or any loss or damage suffered as a result.
- Where a product purchased from Cardinal Solar has internet connectivity capabilities, the Customer:
- Privacy
- Cardinal Solar’s privacy policy is available on the Cardinal Solar website.
- Miscellaneous
- Cardinal Solar will not be liable for any delay or failure to perform its obligations under these Terms if such delay is due to any circumstance beyond its reasonable control.
- Any statements made by a Cardinal Solar representative regarding the Customer’s savings on utility costs after installation of the solar system are provided as an estimate only. The estimated savings are subject to the accuracy of the information provided by the Customer at the time the estimate is calculated and any changes to the utility provider’s rates, charges and fee structures.
- No right under these Terms is waived or deemed to be waived by Cardinal Solar except by notice in writing.
